General Terms and Conditions of Nappy's.eu, located in Meppel (The Netherlands)

General
1.1 These general terms and conditions apply to every offer from Nappy's.eu and to every agreement concluded between Nappy's.eu and the consumer. The conditions are accessible to everyone and included on the website of Nappy's.eu. On request we will send you a written copy.

1.2 By placing an order you indicate that you agree with the terms of delivery and payment. Nappy's.eu reserves the right to change its delivery and/or payment conditions after the expiry of the term.

1.3 Unless otherwise agreed in writing, the general or specific terms and conditions or stipulations of third parties are not recognized by Nappy's.eu.

1.4 Nappy's.eu guarantees that the delivered product complies with the agreement and meets the specifications stated in the offer.

 

Delivery
2.1 Delivery takes place while stocks last.

2.2 In the context of the rules of distance selling, Nappy's.eu will execute orders within at least 30 days, unless a different delivery period has been agreed. If delivery within 30 days or otherwise agreed delivery time is not possible (because the ordered item is out of stock or no longer available), or there is a delay for other reasons, or an order cannot or only partially be executed, the consumer will receive within 1 month after placing the order and in that case he has the right to cancel the order without costs and notice of default.

2.3 Nappy's.eu's obligation to deliver will be fulfilled, subject to proof to the contrary, once the goods delivered by Nappy's.eu have been offered to the customer. In the case of home delivery, the carrier's report, including the refusal of acceptance, serves as full proof of the offer for delivery.

2.4 All terms stated on the website are indicative. No rights can therefore be derived from the stated periods.

 

Prices
3.1 Prices will not be increased within the term of the offer, unless legal measures make this necessary or if the manufacturer implements interim price increases.

3.2 All prices on the site are subject to printing and typesetting errors. No liability is accepted for the consequences of printing and typesetting errors.

3.3 All prices on the site are in Euro and include VAT.

 

Trial period / right of withdrawal
4.1 In the case of a consumer purchase, in accordance with the Distance Selling Act (Article 7:5 of the Dutch Civil Code), the customer has the right to return (part of) the delivered goods within a period of 100 days without giving any reason. This period starts at the moment that the ordered goods have been delivered. Before proceeding to return, the customer is obliged to report this in writing to Nappy's.eu within the period of 100 days after receipt. If the customer has not reported making use of the statutory right of return within the trial period of 100 days after receipt, the purchase is a fact. During the cooling-off period, the consumer will handle the product and the packaging with care. He will only unpack or use the product to the extent necessary to assess the nature, characteristics and functioning of the product. If he makes use of his right of withdrawal, he will return the product to the entrepreneur within 14 days after notifying Nappy's.nl of the intended return in accordance with the reasonable and clear instructions provided by the entrepreneur. The customer must prove that the delivered goods have been returned on time, for example by means of proof of postal delivery. The goods must be returned in the original packaging (including accessories and accompanying documentation) and in new condition. If the goods have been used, encumbered or damaged in any way at the customer, Nappy's.eu reserves the right to charge a reduction in value. With due observance of the provisions of the previous sentence, Nappy's.eu shall, within 14 days after proper receipt of the return shipment or 14 days after proof of return (the contents of the return shipment must be explicitly stated on the proof of shipment), ensure that refund. When the entire purchase is returned, the full purchase amount including any calculated shipping and/or payment costs will be refunded to the customer. When only part of the purchases received are returned, only the purchase value of the returned goods will be refunded. Additional costs resulting from a more expensive shipping method than the cheapest standard delivery will never be refunded. The return of the delivered goods is entirely at the risk of the customer. 4.2 The right of withdrawal does not apply to menstrual cups and menstrual discs. There is a right of withdrawal for other articles. Articles may be tried on over your own underwear. The right of withdrawal does not apply to worn, used and/or washed products. 

Data management
5.1 If you place an order with Nappy's.eu, your details will be included in the Nappy's.eu customer database. Nappy's.eu complies with the General Data Protection Regulation (AVG) and will not disclose your details to third parties. See our Privacy Declaration for a detailed explanation of our privacy policy.
5.2 Nappy's.eu respects the privacy of users of its website and ensures that your personal information is treated in confidence.
5.3 Nappy's.eu uses a mailing list. You will only be added to the mailing list if you subscribe to it. Each mailing contains instructions on how to remove yourself from this list.

Guarantee and conformity
6.1 The trader guarantees that the products and/or services comply with the contract, the specifications stated in the offer, the reasonable requirements of reliability and/or usability and the existing statutory provisions and/or government regulations on the date the contract was concluded.
6.2 An arrangement offered as a guarantee by the trader, manufacturer or importer does not detract from the rights and claims that the consumer can enforce against the trader on the basis of the law and/or the distance contract with regard to a shortcoming in the fulfilment of the trader's obligations.
6.3 If it appears that the delivered goods are incorrect, defective or incomplete, the Buyer must (before returning the goods to Nappy's.nl) notify Nappy's.nl in writing of such defects within 14 days of receipt of the goods. Goods must be returned in their original packaging (including accessories and accompanying documentation). Use of the goods after the discovery of defects, damage occurring after the discovery of defects, encumbrance and/or resale after the discovery of defects, shall nullify this right to complain and return.
6.4 Should Nappy's.eu find any complaints by the Consumer to be justified, Nappy's.eu shall, at its discretion, repair or replace the delivered goods free of charge. Any liability of Nappy's.eu in case of damage shall be limited to a maximum of the invoice amount of the delivered goods, or (at the discretion of Nappy's.eu) to the maximum amount covered under its liability insurance. All liability of Nappy's.eu for any other form of damage is excluded, including additional compensation in any form whatsoever, compensation for indirect or consequential damage or damage due to loss of profit.
6.6 This guarantee does not apply if: A) the Customer is in default vis-à-vis Nappy's.eu; B) the Customer has repaired and/or modified the delivered goods himself or has had them repaired and/or modified by third parties. C) the delivered goods are exposed to abnormal conditions or otherwise carelessly handled or treated contrary to the instructions of Nappy's.eu and/or instructions for use on the packaging;
    

Offers
7.1 Offers are without obligation, unless stated otherwise in the offer.

7.2 Upon acceptance of a non-binding offer by the buyer, Nappy's.eu reserves the right to revoke or deviate from the offer within a period of 3 working days after receipt of that acceptance.

7.3 Oral promises only bind Nappy's.eu after they have been confirmed explicitly and in writing.

7.4 Offers from Nappy's.eu do not automatically apply to repeat orders.

7.5 Nappy's.eu cannot be held to its offer if the customer should have understood that the offer, or a part thereof, contained an obvious mistake or error.

7.6 Additions, changes and/or further agreements are only valid if agreed in writing.

 

Agreement
8.1 An agreement between Nappy's.eu and a customer is concluded after an order has been assessed for feasibility by Nappy's.eu.

8.2 Nappy's.eu reserves the right, without stating reasons, not to accept orders or assignments or to accept them only under the condition that the shipment takes place cash on delivery or after payment in advance.

 

Pictures and Specifications
9.1 All Images; photos, drawings, tables, etc.; including data regarding weights, dimensions, colours, absorption, fit, drying time, rate of moisture absorption, degree of dry feeling, etc. on the website of Nappy's.eu are only approximate, are indicative and cannot give rise to compensation or dissolution of the agreement .

 

Unforeseeable Circumstances/ Force majeure
10.1 Nappy's.eu is not liable if and insofar as its obligations cannot be fulfilled due to force majeure.

10.2 Force majeure is understood to mean any strange cause, as well as any circumstance, which should not reasonably be at its risk. Delays in or non-performance by our suppliers, disruptions in the internet, disruptions in electricity, disruptions in e-mail traffic and disruptions or changes in technology supplied by third parties, transport difficulties, strikes, government measures, delays in supply, negligence by suppliers and/or or manufacturers of Nappy's.eu as well as auxiliary persons, illness of personnel, defects in aids or means of transport are expressly regarded as force majeure.

10.3 In the event of force majeure, Nappy's.eu reserves the right to suspend its obligations and is also entitled to dissolve the agreement in whole or in part, or to demand that the content of the agreement be changed in such a way that execution remains possible. Under no circumstances is Nappy's.eu obliged to pay any fine or compensation.

10.4 If Nappy's.eu has already partially fulfilled its obligations upon the commencement of the force majeure, or can only partially fulfill its obligations, it is entitled to invoice the already delivered or the deliverable part separately and the customer is obliged to pay this invoice as it was a separate contract. However, this does not apply if the already delivered or deliverable part has no independent value.

 

Liability
11.1 Nappy's.eu is not liable for damage caused by the incorrect use of the products. Before use, read the instructions on the packaging and/or consult our website.

 

Retention of Title
12.1 Ownership of all goods sold and delivered by Nappy's.eu to the customer remains with Nappy's.eu as long as the customer has not paid Nappy's.eu's claims under the agreement or earlier or later similar agreements, as long as the customer has performed or work still to be performed under this or similar agreements has not yet been paid and as long as the customer has not yet paid the claims of Nappy's.eu due to failure to comply with such obligations, including claims in respect of fines, interest and costs, a and other as referred to in Section 3:92 of the Dutch Civil Code.

12.2 The goods delivered by Nappy's.eu that fall under the retention of title may only be resold within the framework of normal business operations and may never be used as a means of payment.

12.3 The customer is not authorized to pledge or encumber in any other way the goods subject to retention of title.

12.4 The customer now gives unconditional and irrevocable permission to Nappy's.eu or a third party to be appointed by Nappy's.eu to enter all those places where its property will be located in all cases in which Nappy's.eu wishes to exercise its property rights. and take those things there.

12.5 If third parties seize the goods delivered under retention of title or wish to establish or enforce rights thereon, the customer is obliged to inform Nappy's.eu of this as soon as may reasonably be expected.

12.6 The customer undertakes to insure the goods delivered under retention of title and to keep them insured against fire, explosion and water damage as well as against theft and to make the policy of this insurance available for inspection to Nappy's.eu on first request.

 

Applicable law/competent court
13.1 Dutch law applies to all agreements.

13.2 Disputes arising from an agreement between Nappy's.eu and the buyer, which cannot be resolved in mutual consultation, will be heard by the competent court within the district of North-Netherlands, unless Nappy's.eu prefers to submit the difference to the competent court of subject to the domicile of the buyer, and with the exception of those disputes that fall within the competence of the subdistrict court.

14.1 In cooperation with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden, we offer Postpay as a payment method in countries that are supported by Klarna. Payment must be made to Klarna.
